Electric distribution system conversion moves along

---- — The Pella City Council approved a resolution, following a public hearing, Approving Plans, Specifications, Form of Contract, Estimate of Costs, Receiving Bids and Making Award of Construction Contract for the Electric Distribution System Conversion Project to MasTec North American Inc. of Shevlin, Minnesota, in the amount of $379,266.24.

The project consists of installation of approximately 20 city blocks of underground conduit and secondary cable including bases for devices such as pedestals, transformers, switches and related equipment. The boundaries for this project are: East University Street (north), 500 feet south of East Oskaloosa (south), East Eight Street (west), and Eagle Lane (east).

The estimate for construction was $475,000. The total project estimate is $1,300,000. The Notice to Proceed was scheduled to be issued on or before October 8, 2013. This project has a substantial completion date of June 15, 2014. This resolution also gives the Electric Director, Larry Peterson, authorization to issue the notice to proceed once the contract, bonds, insurance certificates and appropriate permits are in proper order and fully executed.

Council also approved a resolution, following the second public hearing of the evening, Approving Plans, Specifications, Form of Contract, Estimate of Costs, Receiving Bids and Making Award of Materials for the Electric Distribution System Conversion Project.

The project Engineer, DGR, recommends awarding the contracts (to various accepted low bidders) in the total amount of $373,553.85. The Engineer's estimate for material was $425,000. Total project estimate is $1,300,000.

As in the previous resolution, the Notice to Proceed was scheduled to be issued on or before October 8, 2013. This project has a substantial completion date of June 15, 2014. This resolution gives the Electric Director, Larry Peterson, authorization to sign the material agreements and to issue the notice to proceed once the agreements are in proper order and fully executed.

A Governor's Traffic Safety Bureau Contract for 405 Grant, 2013-2014 was next up for approval by council last week.

The Pella Police Department had requested approval to enter into a contract with the Governor's Traffic Safety Bureau to administer the Impaired Driving Countermeasures Grant 14-405d-M60T, Task 43-00-00. This grant provides $11,740 in funds for special traffic enforcement efforts to include: overtime enforcement, training-related travel and educational materials. Furthermore, the funding will purchase one in-car video camera and one set of fatal vision goggles. There are no matching funds required.

The contract is for a time period from October 1, 2013 through September 30, 2014. Participation in this contract is beneficial to the Pella Police Department as it provides equipment for the department that would otherwise need to be purchased.

A resolution Accepting Work on the Sents Creek EQ Basin and Lift Station #2 Improvements was approved by council.

This resolution approves Final Acceptance for the Sents Creek EQ Basin and Lift Station #2 Improvements constructed by C. L. Carroll Co. Inc. The Iowa Department of Natural Resources (IDNR) has required the City of Pella to eliminate all known bypasses in our sanitary sewer collection system by October of 2013. In order to accomplish this mandate, the City was required to add a new 7.0 million gallon earthen equalization basin just upstream of the Sents Creek the Wastewater Plant and construct improvements to Lift Station #2 in order to increase pumping capacity.

The third mandate project, the Force Main, has recently been substantially completed also meeting the October 2013 deadline. The remaining 4th Street Relief Sewer project was granted a one year extension by the IDNR to further study sanitary sewer bypasses and infiltration and inflow (I & I) in this area to confirm the necessity of the project.

With the final resolution of the evening, council approved the Ordering Specifications, Form of Contract, Notice to Bidders, Setting Date for Public Hearing, and Authorizing the Taking of Bids and Authorizing Bid Opening in Connection with the Power Plant Deconstruction Project.

In May of 2012 the City began to receive 100 percent of its energy from Missouri River Energy Services and as a result, the City's power plant is no longer supplying energy for the City. Over the last several months, Burns and McDonnell has been working with City staff to develop plans and specifications and contract documents for the removal of the City's power plant from its current site and restoration of the area to green space.

The Engineer's estimate for this project is $3.9 million.

In other actionThe Pella City Council approved the second reading of an ordinance regarding zoning regulations.

The Board of Adjustment at their June 25, 2013 and July 9, 2013 meetings discussed the Zoning Ordinance regulations pertaining to half story definition and R1 District minimum side setback requirements. The origins of this discussion came out of concern from one of the Board members about cul-de-sac lots, in particular, located in R1 zoning districts and the difficulty in siting large homes on such lots. Out of this discussion, the Board recommended three regulatory changes to the Zoning Ordinance which are outlined below:

Allowable Cantilevering Cantilevering is defined where structural areas project out from the main structure and are suspended over the ground without foundation or support directly beneath. The issue is the current zoning ordinance does not address allowable cantilevering for roofs and decks. Under the proposed ordinance, roofs and decks may cantilever up to a maximum of 2 feet out from the main structure on the same parcel without being subject to minimum district setback requirements. Any additional cantilever beyond 2 feet out shall be subject to applicable district setback requirements. In the case of an enclosed room addition or main structure, cantilever is permitted but must adhere to minimum district setback requirements. It should be noted, the proposed ordinance is consistent with past practice in approving building permits for new homes.

Removal of setback requirements for half story units for all zoning districts This proposed ordinance change removes 1/2 story units from the setback tables such that there would be 1, 2-3 story structure setbacks instead of the current 1-1 1/2, 2-3. The reason for the change is there has been confusion as to what constitutes a 1 1/2 story unit and hence it is difficult under the current zoning code to consistently and uniformly apply the appropriate setback requirements for a 1 1/2 unit.

Side yard setback requirements for R-1 Districts for 2 and 3 story housing units Currently, one story housing units in R-1 Districts have a 10 foot side yard setback versus 12 feet for two and three story housing units. The concern by the Board of Adjustment is there are instances in which one story housing units are taller than two and three story housing units but have less required side yard setbacks. In addition, the Board also believes under the current code it can be difficult to build two and three story housing units on cul-de-sacs and meet the current side yard setbacks. Therefore, this proposed ordinance changes the minimum side setback for RI Zoning District for two and three story structures from 12 feet to 10 feet, which is the same requirement for one story housing units.
